Welcome to Nether Host! These Terms of Service (“Terms”) govern your use of our services. By accessing or using Nether Host, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use our services.

# 1. Definitions

“Nether Host” and "We" refers to the services provided by Nether Host, including but not limited to the website, control panel, and support services.

“User” and "You" refers to any individual or entity that uses Nether Host.

# 2. Account Registration

When you create an account with Nether Host, you agree to provide accurate and complete information. You are responsible for maintaining the security of your account and password. Nether Host cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

# 3. Acceptable Use

You agree to use Nether Host in compliance with all applicable laws and regulations. You may not use Nether Host to engage in any illegal or unauthorized activity. You may not use Nether Host to distribute malware, engage in phishing, or engage in any other malicious activity.

# 4. Termination

Nether Host may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use Nether Host will immediately cease.

# 5. Changes

Nether Host reserves the right to modify or replace these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our website. Your continued use of the service after any changes constitutes your acceptance of the new Terms.

# 6. Refund Policy

Nether Host offers a 48-hour money-back guarantee on all hosting services and account balance charges. If you are not satisfied with our services, you may request a refund within 48 hours of the original payment.

Each customer is eligible to request one (1) refund per calendar year, regardless of the service purchased or payment method used.

Refunds are issued only to the original payment method used or, where applicable, as an account balance adjustment. We reserve the right to withhold a transaction fee of up to 3.5% + $0.30 to cover payment processing costs on routine transactions.

Nether Host reserves the sole right to deny any refund request for any reason, including but not limited to cases where we have identified evidence of abuse or misuse of our services. Examples of abuse include, but are not limited to:

• Violation of our Terms of Service
• Fraudulent or suspicious payment activity
• Excessive resource abuse or service exploitation
• Use of services for malicious, illegal, or prohibited activities
• Attempts to bypass restrictions, safeguards, or billing systems

This list is not exhaustive. Refund eligibility is determined based on our findings, system data, and reasonable judgment at the time of review.

# 7. Prohibited Activities

When using Nether Host, you agree not to:

• Violate any laws or regulations
• Violate the rights of any third party
• Engage in any activity that is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable
• Attempt to interfere with the proper functioning of Nether Host
• Attempt to bypass any security measures

# 8. Limitation of Liability

To the fullest extent permitted by law, Nether Host and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use Nether Host
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service by any third party
• Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via Nether Host

# 9. Service Level Agreement (SLA)

Nether Host guarantees a 99.9% uptime for all services. This SLA covers the availability of our server hosting services but does not apply to any performance issues:

• Caused by factors outside of our control, including but not limited to force majeure events, acts of war, or any other cause beyond our reasonable control
• That result from any actions or inactions of the customer or any third party
• That result from the customer's equipment, software, or other technology and/or third party equipment, software, or other technology

If we fail to meet this guarantee, you may be eligible for a service credit. Please contact us if you think you apply.

# 10. Ownership

Nether Host retains all rights, title, and interest in and to the service, including all intellectual property rights. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the service without our express written permission.

# 11. Dispute Resolution

Before filing a claim against us, you agree to try to resolve the dispute informally by contacting our customer support. We will attempt to resolve the dispute informally within 30 days of receiving your complaint.

# 11.1 Arbitration

If we cannot resolve the dispute informally, you agree to resolve any claim, dispute, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof by binding arbitration. The arbitration will be conducted in the jurisdiction in which Nether Host operates, and you and Nether Host waive any right to a jury trial or to participate in a class action.

# 12. Entire Agreement

These Terms constitute the entire agreement between you and Nether Host regarding your use of our services and supersede all prior and contemporaneous agreements, proposals, or representations, whether written or oral, between you and Nether Host.
